There are three types of visas considered here: the Treaty Trader, Treaty Investor, and the Employment Based Investment Visa.
The two types of Treaty visas require an International Treaty bewteen the Government that issued your passport and the Government of the USA. If there is no such treaty, you can forget these two categories and move on to Employment Based Investment Visas to see if you qualify for that type.
The Treaty Trader is not really an investment visa in that it does not require any monetary investment at all. But it does require a record of ongoing transactions which can be characterized as international trade: imports or exports primarily between your country and the USA. If you are engaged in a substantial trade of goods or services, principally between your country and the USA and you need a visa to monitor the trading activities in the USA, go to our Application page to apply for a Trader visa.
The Treaty Investor visa requires a substantial investment into a real, operating business in the US. The investor must have control of the funds and the investment must not be marginal, i.e. it must have the capacity to generate significantly more income than just enough to provide a living for the investor and his family. Employment Based Investment Visas
This is a new and complicated visa category for persons making an investment of USD one million or more and will be creating full-time employment for ten or more US workers. Investments of less than one million dollars can be acceptable in rual or certain targeted areas of high unemployment. The real attraction of this category is that it entitles the qualifying investor and his immediate family to rights of residence, the so called "Green Card".
